Terms of Service - TakeTips

1. Acceptance of Terms

By creating an account or using the TakeTips platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

TakeTips provides a platform for DJs to receive song requests and tips from their audience during live events. We facilitate payments through our integrated payment processor but are not a party to any transaction between a DJ and their fan. We are not responsible for the quality of DJ services or song selections.

3. Fans and Patrons

This section applies to anyone who submits a song request, message, or tip to a DJ, Musician, or Influencer through the Service ("Fan" or "Patron"). You do not need a TakeTips account to submit a request.

Tips are entirely optional. Tipping is voluntary and is never required to use the Service. A tip is a gratuity given to show appreciation; it is not a purchase of goods or services. Where a DJ offers free requests, you may submit one without tipping.
No guarantee a request will be played. Submitting a request, with or without a tip, does not guarantee that a song will be played, played at a particular time, or played in full. Whether, when, and in what order requests are played is at the sole discretion of the DJ, and may depend on factors such as the event's schedule, the venue, the crowd, the song's suitability, or its availability.
Priority queue is not a guarantee. Some DJs enable a priority queue that orders pending requests by tip amount. Any queue position or estimated wait time shown to you is an estimate for information only; the DJ may still play requests in any order, or not at all.
Tips create no obligation. No tip, of any amount, creates a contract, obligation, or entitlement between you and the DJ or TakeTips.
No refunds for unplayed requests. A request not being played is not grounds for a refund. Any refund is provided solely at the discretion of the DJ who received the tip, as described in Section 5.
What the DJ sees. The details you submit with a request, such as your name, song request, message, and any social handle you choose to add, are shared with the DJ you are requesting from so they can view and respond to your request.
Payment methods. Tips made by card, Apple Pay, Google Pay, or Cash App Pay are processed by Stripe and are subject to the same terms as any other tip.
Off-platform payments. If you pay a DJ directly outside of TakeTips (for example, with cash or Zelle), that payment is handled entirely between you and the DJ. TakeTips does not process, track, or refund off-platform payments.
Authorized payment methods. You must be legally permitted to use the payment method you provide, and you agree that all tips are final once processed.

4. User Accounts

You must provide accurate and complete information when creating your account.
You are solely responsible for maintaining the security of your account and password.
You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
Each individual or entity is permitted one account.
TakeTips supports three account types: DJ, Musician, and Influencer. Each type has a dedicated onboarding path and may have access to different platform features over time. The core rules in these Terms apply equally to all account types unless otherwise stated.

5. Payments and Fees

Per-Tip Fees

TakeTips charges a platform fee of 15% on all tips processed through the Service.
You receive the remaining 85% of the tip amount, less any standard processing fees from our payment partner, Stripe.
All payments are processed securely by Stripe. By using the Service, you agree to Stripe's terms and conditions.
All tips are final. Refunds are provided solely at the discretion of the account holder. TakeTips is not responsible for mediating payment disputes.

Premium Subscription

TakeTips offers optional paid subscription plans (monthly and yearly) that unlock additional platform features ("Premium").
Subscription fees are billed in advance on a recurring basis through Stripe. By subscribing, you authorise Stripe to charge your payment method automatically at each renewal interval.
You may cancel your subscription at any time from your dashboard settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
TakeTips reserves the right to change subscription pricing with reasonable advance notice. Continued use of Premium features after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to use the Service to:

Engage in any illegal, fraudulent, or malicious activities.
Harass, abuse, or harm another person.
Submit inappropriate, offensive, or obscene song requests or messages.
Attempt to circumvent platform fees or manipulate the tipping system.
Violate the intellectual property rights of others.

7. Content Rights

You retain all rights to the content you post on your profile (e.g., DJ name, bio, images).
By using the Service, you grant TakeTips a non-exclusive, worldwide, royalty-free license to display your public profile content for the purpose of operating and marketing the Service.

8. Limitation of Liability

The Service is provided "as is" without any warranties. TakeTips is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim arising out of these terms or the Service will not exceed the amount of platform fees paid by you to TakeTips in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms. You may delete your account at any time from your dashboard settings. Termination does not affect any pending payouts owed to you.

10. Changes to Terms

We may update these terms from time to time. We will notify you of any significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
